1. Acceptance of Terms
By registering for, accessing, or using the services provided by Editorial3D Inc. ("Editorial3D", "we", "us", or "our"), including the website at editorial3d.com, the web application at app.editorial3d.com, and any associated APIs, 3D flipbook embed scripts, or viewer widgets (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").
If you are using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have full legal authority to bind that entity to these Terms. If you do not agree to all terms and conditions set forth herein, you may not access or use the Service.
2. Description of Services & Lifetime License Scope
Editorial3D provides a digital publishing platform that converts Portable Document Format ("PDF") files into interactive, photorealistic, page-turning 3D flipbooks rendered in real-time via WebGL.
Purchases of Editorial3D plans (including Starter, Growth, and Scale tiers) are granted as a non-exclusive, non-transferable, revocable lifetime license for the lifetime of the Service. "Lifetime" refers to the operational life of the Editorial3D platform and does not guarantee an indefinite duration in the event of platform discontinuation or force majeure.
3. User Accounts, Authentication & Security
To use our publishing features, you must register for an account using our authentication system. You agree to provide accurate, complete, and updated information. You are solely responsible for safeguarding the credentials associated with your account and for all activities that occur under your account.
You must notify Editorial3D immediately of any unauthorized use or breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.
4. View Quotas, Overages & Top-Up Packs
Each lifetime plan includes an active publication limit and a recurring monthly view allowance across all your flipbooks combined:
- Starter ($35): Up to 25 active publications and 5,000 views per calendar month.
- Growth ($70): Up to 50 active publications and 15,000 views per calendar month.
- Scale ($100): Up to 100 active publications and 30,000 views per calendar month. Scale tier is stackable in additional 100-publication increments.
A "view" is recorded whenever a unique reader loads or accesses the interactive flipbook viewer on any device or embedded website. View allowances automatically reset to zero at 00:00 UTC on the first day of each calendar month.
Uninterrupted Service Policy: If your publications exceed their monthly view allowance during a traffic surge, Editorial3D will not immediately suspend or shut down active flipbooks. Instead, an account overage notice will be issued, and you may purchase additional view top-up packs (+5,000 views for $10) via your dashboard. Unused top-up views do not roll over to subsequent months.
5. Storage Quotas, File Sizes & Retention
All PDF uploads are limited to a maximum file size of 50 megabytes (MB) per file. Editorial3D stores publication assets and rendered page texture tiles on distributed cloud edge storage (Cloudflare R2).
You may unpublish, delete, or replace publications at any time. When a publication is permanently deleted from your dashboard, all associated page textures and reader telemetry records are deleted within 30 days, except where retention is required by applicable law.
6. Customer Content & Intellectual Property
Your Content: You retain full ownership, title, copyright, and all other intellectual property rights in and to all PDF documents, images, text, trademarks, and media ("Customer Content") that you upload or publish via Editorial3D.
License to Editorial3D: You grant Editorial3D a worldwide, non-exclusive, royalty-free license solely to host, cache, render, display, transmit, and create page-tile derivative textures of your Customer Content for the sole purpose of providing the interactive viewer and publishing service to you and your readers.
Editorial3D IP: The Editorial3D name, logo, 3D WebGL page-curl rendering engine, source code, user interface, software algorithms, documentation, and design assets are the proprietary property of Editorial3D Inc. and are protected by international copyright and intellectual property laws.
7. Acceptable Use & Prohibited Conduct
You agree not to upload, publish, or distribute any Customer Content or use the Service in any manner that:
- Violates any applicable federal, state, local, or international law or regulation;
- Infringes upon the copyright, patent, trademark, trade secret, or privacy rights of any third party;
- Contains malicious software, viruses, trojans, phishing scripts, or deceptive links;
- Promotes illegal activities, violence, hate speech, terrorism, or unauthorized sale of regulated goods;
- Attempts to reverse-engineer, decompile, scrape, or circumvent the access controls or licensing mechanisms of the Service.
Editorial3D reserves the right to remove any publication and suspend or terminate accounts that violate this policy without notice or refund.
8. Payments, Billing, Taxes & Refund Policy
One-Time Payments: Plan purchases and view top-up packs are billed via our third-party payment processor (Stripe). You agree to provide a valid payment method and authorize Editorial3D to charge the specified one-time fee plus any applicable sales tax or VAT.
14-Day Money-Back Guarantee: We offer a hassle-free 14-day refund policy on all lifetime tier purchases. If you are unsatisfied with Editorial3D for any reason, submit a written refund request to support@editorial3d.com within 14 calendar days of your initial purchase date for a full refund. Top-up view packs that have already been consumed are non-refundable.
9. Custom Domains, White-Label & Custom SMTP
Custom Domains: When configuring a custom CNAME domain (e.g., catalog.yourbrand.com), you are responsible for maintaining DNS records and domain ownership. We provide automated SSL certificate generation via Cloudflare.
Custom SMTP: If you configure custom SMTP credentials to send transactional lead gate notifications, you represent that you possess valid authorization to send emails through your configured server and agree not to use the SMTP integration for spam or unsolicited commercial emails.

12. Termination, Governing Law & Dispute Resolution
